DKSH Holding Ltd and its affiliated company take your data protection rights and our legal obligations seriously. The information that you provide to us in the course of your application for employment with us as well as other information relating to you ("Personal Data") will be treated in a secure and confidential manner as set out in this Privacy Notice ("Notice"). 

DKSH Holding Ltdとその関係会社は個人情報の保護と法令による義務を重要事項として位置付けております。当社における雇用に応募する過程で提供された貴殿の情報、および、そのほかの貴殿の情報（以下、「個人情報」とします）は、本通知（以下、「通知」とします）に記載のとおり、保護され、かつ、秘密裡に取り扱われております。 

1. Data Controller / List of Controllers

The Data Controller of your Personal Data is the company of the DKSH Group that has posted the specific vacancy for which your application is suited.   

In particular, depending on the company of the DKSH Group that has activated a specific position, the Data Controller may be one of the companies listed hereunder: link

2. Personal Data We Collect

We may collect and process various types of Personal Data about you for the purposes described in this Notice, including: 

本通知に記載されている目的のために、以下のような貴殿の各種個人情報を収集し取り扱うことがあります。 

• Data about you: forename and surname, gender, nationality, civil/marital status, date of birth, age, home contact details (e.g., address, telephone number, e-mail), emergency contact details (name and telephone number) national ID number, immigration and eligibility to work data, next-of-kin/dependent contact information, heath records.   

貴殿の個人の属性に関する情報：　姓および名、性別、国籍、市民権、婚姻、生年月日、年齢、住所に関する詳細（例：住所、電話番号、電子メール）、緊急連絡先（氏名および電話番号）、政府によるＩＤ番号、在留許可や就労許可に関する情報、配偶者・被扶養者への連絡先、健康記録 

• Data about your employment history and qualifications: qualifications, references 

貴殿の職務経歴および資格に関する情報：　資格、紹介者 

• Data about your application: CV and application, interview data, audio and video recordings of interviews, as applicable, verification of references

3. How We Collect Your Data

You may give us the Personal Data described above during the recruitment process, whether through your application, further communications, on the telephone or at interviews.  

上記の貴殿の個人情報は、選考の過程において、貴殿の応募の段階、その後の連絡、電話または面接を通じて提供されます。

We may also receive or obtain Personal Data about you from third parties; for example, recruiters; references from a previous employer; business partners; sub-contractors providing recruiting or technical services; analytics providers (such as companies that benchmark professional careers); background check providers; search information providers; and reference agencies (such as companies that provide credit scores), as well as from publicly available sources such as social media where such Personal Data is proportionate to the position for which you are applying.  We may also retain that Personal Data after you have been employed (where this is relevant and to the extent permitted by applicable law). 

さらに、第三者から貴殿の個人情報を受け取り、または、入手することがあります。例えば、人材紹介会社、貴殿の前職、ビジネスパートナー、リクルートまたは技術サービスを提供する下請け先、分析提供者（たとえば、職務経歴をベンチマークするような会社）、バックグランドチェックを提供する者、サーチ情報の提供者、リファレンスの代行業者（クレジットのスコアを提供する企業など）、ソーシャルメディアを経由した公知の情報であって貴殿が応募しているポジションと関係があるもの、等。貴殿が雇用された後でも、それらの個人情報を保持する可能性があります（必要がある限りにおいて、かつ、関連する法律の許容する範囲において） 

We may also receive information which may include your Personal Data from our hiring manager, from Human Resources, and, from time to time, from our other employees (for instance, in the course of conducting an interview). 

加えて、貴殿の個人情報を含む情報を、貴殿を採用する部門の責任者、人事部、および、時として、そのほかの社員から入手する可能性があります（例えば、面接を通じて）。 

4. Why We Process Your Personal Data and Legal Basis for Processing 

個人情報の加工の理由と法的根拠 

The Personal Data requested from you during the recruitment process is required by us in order to assess your application for employment with the Company. If you do not provide some or all of this Personal Data it may affect our ability to process your application and therefore to enter into an employment agreement with you. In some cases, it may mean that we are unable to continue with your application for employment as the Company will not have the Personal Data we believe to be necessary for the effective and efficient management of the recruitment process. 

採用手続きを通じて貴殿から提供された個人情報は、当社が貴殿を雇用するための精査をするうえで必要とされています。もしも貴殿がこれらの個人情報の一部またはすべてを提供しない場合には、貴殿の応募手続きを進めること、および、貴殿と雇用契約を締結することに対して影響を及ぼす可能性があります。 

We collect the Personal Data described in Section 2 above for the purposes of managing the Company’s recruitment related activities. The Company may also use your Personal Data in relation to the evaluation and selection of applicants, including for example setting up and conducting interviews and tests, and conducting evaluations, assessments and otherwise as needed in the recruitment process, including if relevant, issuing employment offers.  

当社における採用活動を管理する目的で、セクション２に記載する個人情報を収集します。当社は、応募者の評価と選抜に関する貴殿の個人情報を、例えば面接やテスト、評価、精査、雇用のオファーも含め、その他採用活動に必要とされる限りにおいて利用する可能性があります。 

We process your Personal Data for the purposes described above on at least one of the following legal bases: 

当社は、貴殿の個人情報を少なくとも以下に記載する法的根拠の一つにより取り扱います。 

• the processing is necessary for compliance with a legal obligation to which the Company is subject (notably verifying eligibility for employment or complying with obligations regarding non-discrimination, if any); or 

当社が従わなければならない法的義務に基づき取り扱う必要があるとき（特に、雇用の可否を確認する、または差別禁止義務に従う必要があるとき、など） 

• the processing is necessary in order to take steps at your request prior to entering into an employment contract with you (notably verifying your qualifications and work history); or  

貴殿との雇用契約締結に先立って、貴殿の要請に基づいた手順に従って取り扱う必要があるとき（特に、貴殿の資格や職務経歴を確認する必要があるとき、など） 

• the processing is necessary for the legitimate interests pursued by the Company in hiring qualified and appropriate persons (notably by conducting interviews), except if in light of particular circumstances our interests are overridden by your interests or fundamental rights and freedoms that require protection of personal data. 

当社が適格かつ適切な人材を雇用するにあたって、当社が追求する正当な利益のために必要があるとき（特に、面接を通じて）。ただし、特定の状況に照らして、個人情報の保護を必要とする貴殿の利益または基本的権利と自由が、当社の利益に優先する場合を除きます。 

The processing of legal or criminal records data will be undertaken in compliance with applicable laws and in specific circumstances (e.g., for candidates for positions in the Finance Department), where required or permitted by the applicable laws, national collecting bargaining agreements or binding resolutions of the relevant Data Protection Authority. The legal basis for such processing will be necessity for compliance with a legal obligation, and/ or the Company’s legitimate interests in hiring, for roles involving the regular handling of significant assets, persons who have proven their reliability and probity and/or your explicit consent, as applicable and required by local laws. 

法的記録または犯罪記録データは、適用法、国の徴収交渉協定、または関連する情報保護当局の拘束力のある決議によって要求または許可されている場合、適用法および特定の状況（財務経理部門の役職の候補者など）に従って取り扱われます。その国の法律で適用され要求される法的義務の遵守の必要性、および/または重要な資産の日常的な取り扱いを伴う役職の雇用における当社の正当な利益、信頼性と誠実性が証明された人物、および/または貴殿の明示的な同意が、当該処理の法的根拠となります。 

If You provide us with Personal Data of other individuals (e.g., emergency contacts), You confirm that you have obtained their consent to share their information with us for the purpose outlined in this Notice.  

貴殿が、他者の個人情報（例えば、緊急連絡先）を当社に提供する場合には、本通知に記載する目的のために当社に情報提供することを、貴殿はすでに当該他者から同意を得ていることを確認します。 

5. With Whom Do We Share Your Personal Data? 

貴殿の個人情報の共有先 

As a global organization consisting of businesses in various countries, the Company may hire for its sites, and use resources, located throughout the world. Your Personal Data may be shared with affiliated companies where it is reasonable and necessary to do so. Within the Company, your Personal Data can be accessed by or may be disclosed internally on a need-to-know basis to persons responsible for managing or making hiring decisions, Human Resources staff, system administrators and other support teams (such as IT and Finance). 

当社は、さまざまな国の事業所で構成されるグローバル組織であるため、世界各地にある拠点に人員を雇用し、リソースを使用する場合があります。貴殿の個人情報は、合理的かつ必要な場合に関連会社と共有されることがあります。社内では、管理や採用の決定を行う責任者、人事スタッフ、システム管理者、その他のサポートチーム（ITや財務など）が必要に応じて貴殿の個人情報にアクセスしたり、開示したりすることがあります。 

Your Personal Data may also be accessed by third parties who provide us with services relevant to your recruitment, namely recruiters; companies (notably SuccessFactors) that host, support and/or maintain the IT systems or applications supporting our recruitment and other HR systems; and companies that verify your references, undertake background checks or conduct vetting on our behalf. 

貴殿の個人情報は、採用に関連するサービスを当社に提供する第三者、すなわちリクルート会社、当社の採用およびその他の人事システムをサポートするITシステムまたはアプリケーションをホスト、サポート、および/または保守する企業（特にSuccessFactors）、および貴殿のリファレンスを確認し、身元調査を実施し、または当社に代わって審査を行う企業、によってアクセスされる場合もあります。 

If your application for employment with the Company is successful and you accept a job offer from us, your Personal Data may also be shared with HR information, payroll and benefits systems, and the Personal Data contained in such systems may be accessible by providers of those systems, their affiliated companies and sub-contractors; tax authorities; regulatory authorities; and our lawyers, auditors, investors, consultants and other professional advisors.  

当社への就職の応募が成功し、当社からのジョブオファーを承諾した場合、貴殿の個人情報は人事情報、給与および福利厚生システムと共有される可能性があり、そのようなシステムに含まれる個人情報は、それらのシステムのプロバイダー、その関連会社、および下請け業者によってアクセスされる可能性があります。 

The Company expects all third parties to process any Personal Data disclosed to them in accordance with applicable law and contract terms, including with respect to Personal Data confidentiality and security. Where these third parties act as a "data processor" (for example, by verifying your references at our request), they carry out their tasks on our behalf and upon our instructions for the above mentioned purposes. In this case, your Personal Data will only be disclosed to these parties to the extent necessary to provide the required services.  

The Company will not disclose your Personal Data to unauthorized third parties.  

当社は、すべての第三者が、個人情報の機密性とセキュリティに関するものを含め、適用法および契約条件に従って、開示された個人情報を処理することを期待しています。 

これらの第三者が「データ処理業者」として機能する場合（たとえば、当社の要請に応じて貴殿のリファレンスを確認するなど）、上記の目的のために当社に代わって当社の指示に従って業務を遂行します。この場合、貴殿の個人情報は、必要なサービスを提供するために必要な範囲でのみこれらの当事者に開示されます。当社は、貴殿の個人情報を許可のない第三者に開示することはありません。 

6. Data Transfers Outside your country 

貴殿の個人情報の国外への転送 

From time to time your Personal Data will be transferred outside your country for the purposes described in this Notice. For example, your Personal Data may be transferred, among other purposes, to conduct the review of your application, the processing of your details and the provision of support services. 

We may share your Personal Data (i) with colleagues within the Company; (ii) with colleagues within the DKSH Group (both in the country where you are applying for a position, and in other countries in which the group has operations (including countries outside your country); and (iii) with third parties as described in this Notice.   

貴殿の個人情報は、本通知に記載された目的のために、随時貴殿の国外に転送されることがあります。 

例えば、貴殿の個人情報は、貴殿の応募の審査、貴殿の詳細情報の処理、サポートサービスの提供などの目的で転送される場合があります。 

当社は、貴殿の個人情報を（i）当社内の同僚、（ii）DKSHグループ内の同僚（貴殿が応募している国の同僚と、グループが事業を展開している他の国（貴殿の国以外の国を含む）の両方）、および（iii）本通知に記載されている第三者と共有する場合があります。 

We will provide you upon your request a list of the countries located outside your country to which your Personal Data may be transferred, and an indication of whether they have been determined  to grant adequate protection to Personal Data. Please send your request as indicated in How to Exercise Your Rights below.  

当社は、貴殿の要望に応じて、貴殿の個人情報が移転される可能性のある国外の国のリストと、それらの国が個人情報を適切に保護していると判断されているかどうかを示します。以下の権利行使方法に従ってリクエストを送信してください。 

In case of transfers outside your country, we will ensure appropriate safeguards, such as  Standard Contractual Clauses, Binding Corporate Rules, or other legally acceptable mechanisms that ensure an adequate level of protection. Where applicable, you are entitled to receive a copy of the relevant contract (such as Standard Contractual Clauses or Binding Corporate Rules) showing that appropriate safeguards have been taken to protect your Personal Data in connection with such transfer. Please send your request as indicated in How to Exercise Your Rights below. 

Transfers of Personal Data are based on the same legal basis as applicable for the respective purposes of processing as set forth in Section 4 above.  

貴殿の国外への転送の場合、標準契約条項、拘束的企業準則、または十分なレベルの保護を保証するその他の法的に認められたメカニズムなど、当社は適切な保護手段を確保します。該当する場合、貴殿は、かかる転送に関連して貴殿の個人情報を保護するために適切な保護措置が講じられていることを示す関連契約（標準契約条項や拘束的企業準則など）のコピーを受け取る権利があります。以下の権利行使方法に従ってリクエストを送信してください。 

個人情報の転送は、上記セクション4に定める処理の目的に適用されるものと同じ法的根拠に基づいて行われます。 

7. Data Retention 

情報の保持 

Our general approach is to retain candidate Personal Data for one year from completion of the last vacancy you applied for, to the extent you were a suitable candidate for the vacancy, so that we may consider you for future job openings, unless you expressly object. In all cases, we will retain your Personal Data for exercising or defending legal claims, for a period of time corresponding to the applicable statute of limitations, or legal or regulatory obligations. 

If you accept employment with Company, your Personal Data will be held on the basis set out in our Employee Privacy Notice, which is provided to all employees and that you will be required to acknowledge that you have read. 

当社の一般的な方針は、貴殿が応募した最後の求人の終了から一年間、貴殿がその求人に適した候補者であった限り、候補者の個人情報を保持し、貴殿が明示的に反対しない限り、将来の求人に貴殿を検討できるようにすることです。いずれの場合も、当社は、適用される時効期間、または法律上または規制上の義務に対応する期間、法的請求の行使または防御のために貴殿の個人情報を保持します。 

当社の雇用を受け入れた場合、貴殿の個人情報は、全従業員に提供される従業員プライバシー通知に定められた基準に基づいて保持され、貴殿はそれを読んだことを認める必要があります。 

8. Your Rights 

貴殿の権利 

• Right to Access - you have the right to request access to any of your Personal Data that the Company may hold, and to obtain information about the processing of that data.    

アクセス権 – 貴殿には、当社が保有する貴殿の個人情報へのアクセスを要求し、そのデータの処理に関する情報を取得する権利があります。 

• Right to Correct - the Company will take steps in accordance with applicable legislation to keep your Personal Data accurate, complete and up-to-date. You are entitled to have any inadequate, incomplete or incorrect Personal Data corrected (that is, rectified). You also have a responsibility to ensure that changes in personal circumstances are notified to the Company so that we can ensure that your Personal Data is up-to-date. 

訂正権 – 当社は、適用される法律に従って、貴殿の個人情報を正確、完全、最新の状態に保つための措置を講じます。貴殿は、不十分、不完全、または不正確な個人情報を訂正（つまり修正）する権利を有します。また、貴殿の個人情報が最新のものであることを保証できるよう、個人的な状況の変化を当社に通知する責任も負います。 

• Right to Withdraw Consent - in the event your Personal Data is processed on the basis of your consent, you have the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.  

同意を撤回する権利 – 貴殿の個人情報が貴殿の同意に基づいて処理される場合、貴殿は、撤回前の同意に基づく処理の合法性に影響を与えることなく、いつでも同意を撤回する権利を有します。 

• Data Portability - where we are relying (as the legal basis for processing) upon your consent, or the fact that the processing is necessary to perform a contract to which you are party or to take steps at your request prior to entering a contract, and the Personal Data is processed by automatic means, you have the right to receive all such Personal Data which you have provided to the Company in a structured, commonly used and machine-readable format, and also to require us to transmit it to another controller where this is technically feasible. 

データポータビリティ – 当社が（処理の法的根拠として）貴殿の同意に依拠している場合、または貴殿が当事者となっている契約を履行するために、もしくは契約締結前に貴殿の要請に応じて措置を講じるために処理が必要であるという事実、および個人情報が自動的な手段によって処理される場合において、貴殿は、構造化され、共用され、機械で読み取り可能な形式で提供したすべての個人情報を受け取る権利を有し、また、技術的に実行可能な場合は、当社にそれを別の管理者に送信するよう要求する権利を有します。 

• Right to Erasure - you are entitled to have your Personal Data erased under specific circumstances, such as where you have withdrawn your consent, where you object to processing based on legitimate interests and we have no overriding legitimate grounds (see below) or where Personal Data is unlawfully processed. 

消去権 - 同意を撤回した場合、正当な利益に基づく処理に異議を唱え、当社に優先する正当な理由がない場合（以下を参照）、または個人情報が違法に処理された場合など、特定の状況下では個人情報を消去する権利があります。 

• Right to Restriction of Processing - you have the right to restrict our processing of your Personal Data (that is, allow only its storage) where:  

処理の制限の権利 – 貴殿は、以下の場合に、当社による貴殿の個人情報の処理を制限する権利（つまり、保管のみを許可する権利）を有します。 

• you contest the accuracy of the Personal Data, until we have taken sufficient steps to correct or verify its accuracy;  

個人情報の正確性に異議を唱える場合、当社がその正確性を修正または検証するための十分な措置を講じるまで 

• the processing is unlawful but you do not want us to erase the Personal Data; 

 処理は違法だが、個人情報を消去したくない場合 

• we no longer need your Personal Data for the purposes of the processing, but you require such Personal Data for the establishment, exercise or defence of legal claims; or  

当社が処理の目的で貴殿の個人情報を必要としなくなったが、貴殿が法的請求の確立、行使、または防御のためにそのような個人情報を必要とする場合 

• you have objected to processing justified on legitimate interest grounds (see below), pending verification as to whether the Company has compelling legitimate grounds to continue processing. 

正当な利益を理由として処理に異議を申し立てた場合（下記参照）、当社が処理を継続する正当な理由があるかどうかの確認が保留中の場合 

• Where your Personal Data is subject to restriction we will only process it with your consent or for the establishment, exercise or defence of legal claims. 

貴殿の個人情報が制限の対象となる場合、当社は貴殿の同意を得た場合、または法的請求の確立、行使、防御のためにのみ、その情報を処理します。 

• Right to Object to Processing Justified on Legitimate Interest Grounds - where we are relying upon our legitimate interests to process Personal Data, you have the right to object to that processing.  If you object, we must stop that processing unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights and freedoms, or we need to process the Personal Data for the establishment, exercise or defence of legal claims. Where we rely upon legitimate interest as a basis for processing, we believe that we can demonstrate such compelling legitimate grounds, but we will consider each case on an individual basis. 

正当な利益に基づく処理に異議を申し立てる権利 - 当社が正当な利益に基づいて個人情報を処理する場合、貴殿はその処理に異議を申し立てる権利を有します。異議を申し立てる場合、当社は、貴殿の利益、権利、自由に優先する処理の正当な根拠を証明できる場合、または法的請求の確立、行使、防御のために個人情報を処理する必要がある場合を除き、その処理を停止する必要があります。 

当社が正当な利益を処理の根拠とする場合、当社はそのような説得力のある正当な根拠を証明できると考えていますが、個々のケースについて検討します。 

• You also have the right to lodge a complaint with the supervisory authority of your habitual residence, place of work or place of alleged infringement, if you consider that the processing of your Personal Data infringes applicable law.   

また、個人情報の処理が適用法に違反していると思われる場合は、居住地、勤務地、または侵害の疑いのある場所の監督当局に苦情を申し立てる権利もあります。

10. Changes to This Notice 

本通知に対する変更 

Any changes or updates we may make to this Notice will be posted on this page in advance, if applicable.  If we still have your email on file, as described in Section 7 above, we will notify you in advance of any changes to this Notice that are material or may impact you.  For other changes, please check back frequently to see any updates or changes to this Notice. 

この通知に何らかの変更や更新があった場合であって該当する場合には、事前にこのページに掲載されます。上記のセクション7に記載されているように、貴殿のメールアドレスがまだ記録されている場合は、この通知に重大な変更があった場合、または貴殿に影響を及ぼす可能性がある場合には、事前に通知します。
